General Terms and Conditions

1. Acceptance of Terms

Learn P Driving School Castle Hill (“the Driving School”, “we”, “our”, “us”) provides driving instruction services in and around the areas displayed in our booking system. These Terms and Conditions constitute a legally binding agreement between the participant (“you”, “the learner”) and Learn P Driving School Castle Hill.

By booking, attending, or participating in any driving lesson or service, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.

These Terms may be amended from time to time. Any updates will be published on our website at www.learnpdrive.com. The Terms in effect at the time of booking shall apply to that booking.


2. Service Areas and Pick-Up Locations

Lessons are provided only in areas listed in our booking system. Requests for pick-up or drop-off locations not listed must be discussed and approved in advance by contacting 0401 950 730.

We do not provide pick-up or drop-off services from schools, playgrounds, clubs, or similar venues.


3. Bookings

  • Lessons may be booked via:

    • Phone or SMS: 0401 950 730

    • Online booking system

  • Standard lessons may be booked up to 7 days in advance.

  • Driving test bookings may be made up to 28 days in advance, subject to availability.

  • Regular lessons may be scheduled up to 10 days in advance, subject to instructor availability

  • Briefing and debriefing time is included in the lesson duration.

  • Lessons commence and conclude at the pre-agreed pick-up/drop-off location.

The Driving School reserves the right to refuse any booking at its discretion.


4. Payment Conditions

  • Full payment is required at the time of booking unless otherwise agreed in writing.

  • If payment has not been received in full, no booking will be created and no lesson is guaranteed.

  • Any outstanding fees constitute a debt payable immediately upon demand.

  • Accepted payment methods:

    • EFTPOS (3% surcharge applies)

    • Electronic Funds Transfer (EFT)

    • Direct Deposit

  • A formal tax invoice will be issued for all payments.

By booking, you warrant that:

  • You are at least 18 years of age or have legal parental/guardian consent.

  • You are authorised to make payment.

  • All information provided is accurate and complete.


5. Lesson Packages and Refunds

  • Package lessons are charged at the individual lesson rate if the full package is not completed prior to passing the driving test.

  • Students are permitted to schedule no more than two (2) lessons concurrently within the scope of their purchased package.
  • Any approved refund is subject to a $60 administrative fee.

  • A $10 processing fee applies to all refunds.


6. Cancellations, Rescheduling & Late Arrivals

  • Lessons may be cancelled or rescheduled at least 48 hours prior without penalty.

  • Cancellations within 48 hours:

    • Less than 48 hours: 50% of lesson fee charged

    • Less than 4 hours or no-show: 100% of lesson fee charged

  • If you are more than 10 minutes late without notice, the instructor may cancel the lesson and charge the full fee.

  • If you arrive late, lesson time may be reduced and the full fee will still apply.

  • The Driving School reserves the right to reschedule lessons with reasonable notice via SMS.

  • Lessons may be refused if the learner is deemed unfit to drive.


7. Licence Requirements

A physical or digital licence must be presented at every lesson.
Photographs, screenshots, or copies are not accepted.


8. Use of Learner’s Own Vehicle

Lessons in the learner’s vehicle require instructor approval and will:

  • Start and finish at Castle Hill RMS parking

  • Be conducted entirely at the learner’s risk

The learner is solely responsible for:

  • Vehicle registration and roadworthiness

  • Valid insurance

  • Compliance with NSW traffic laws

The instructor reserves the right to terminate the lesson immediately if safety concerns arise. Full lesson fees will apply.


9. Private Vehicle Conditions

Vehicle Requirements

  • Registered and roadworthy

  • Valid insurance

  • Road-legal tyres

  • Functional seatbelts

  • No cracked windscreen

  • Sufficient fuel

Iinsurance

The learner must notify their insurer in writing prior to the lesson.

  • The learner is responsible for all traffic infringements.

Liability

  • The learner indemnifies the Driving School against all claims, loss, damage, or liability.


10. Driving Packages – Booking Limitations

Under any booked package, a maximum of two (2) active bookings is permitted at any one time.
Bookings exceeding this limit may be cancelled or rescheduled at the Driving School’s discretion.


11. Parent/Guardian Attendance & Private Practice Disclaimer

The Driving School and its instructors do not have authority to advise parents or learners on when private driving with family members may commence.

One (1) parent or guardian may attend one lesson only for observation purposes. Such attendance does not constitute approval or advice regarding private driving practice.


12. Mobile Phone & Device Use Policy

Student Mobile Phone Use

  • Mobile phone use by students is strictly prohibited while the vehicle is in motion.

  • Calls or messages may only be made or answered when the vehicle is safely and completely stopped.

  • The instructor will determine whether a call is urgent and may permit or respond to such calls only when it is safe to do so.

  • Any lesson time interrupted due to phone use may be added to the session where possible or adjusted accordingly.

    Instructor Mobile Device Use


  • During driving lessons, a mobile device may be securely mounted and used strictly for navigation purposes (e.g., Google Maps with live traffic updates). This is standard practice to assist with route planning and real-time traffic awareness.

  • The instructor does not engage in personal browsing or unrelated phone activity during lessons.

  • Students acknowledge that modern smartphones may occasionally display automated notifications, predictive text suggestions, or voice-activated search prompts without deliberate manual input. Such system-generated features do not represent intentional searches or personal activity by the instructor.

  • Student safety, road awareness, and professional instruction remain the highest priorities at all times.



13. Provision of Lessons & Conduct

You must follow all instructor directions at all times. Lessons may be terminated if:

  • Unsafe or inappropriate behavior occurs

  • Licence conditions are breached

  • The learner is deemed unsafe to drive

Full lesson fees apply if a lesson is terminated.


14. Vehicles Supplied by the Driving School

  • Automatic transmission vehicles only

  • Vehicles may contain GPS and recording systems

  • Insurance excess of $850 applies if damage occurs due to learner fault

  • Learners are responsible for all traffic offences


15. Fitness to Drive

If deemed unfit or unsafe at any time, the instructor may immediately terminate the lesson. Full fees apply.


16. Privacy

Personal information and lesson recordings may be collected, stored, and shared with relevant authorities for operational, legal, and safety purposes.


17. Acknowledgements

Student Acknowledgement

  • Passing a driving test is not guaranteed

  • Driving involves inherent risks

  • Lessons may be recorded

  • Results and photos may be shared on social media

  • By proceeding with lessons, students confirm their understanding and acceptance of this policy.

    Any concerns regarding lesson conduct should be raised directly with the instructor at the time of the lesson to allow immediate clarification and resolution.
