General Terms and Conditions

1. Acceptance of Terms

Learn P Driving School Castle Hill (“the Driving School”, “we”, “our”, “us”) provides driving instruction services in and around the areas displayed in our booking system. These Terms and Conditions constitute a legally binding agreement between the participant (“you”, “the learner”) and Learn P Driving School Castle Hill.

By booking, attending, or participating in any driving lesson or service, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.

These Terms and Conditions may be amended from time to time. Any updates will be published on our website. The Terms and Conditions in effect at the time of booking shall apply to that booking.

2. Service Areas and Pick-Up Locations

Lessons are provided only in areas listed in our booking system.

Requests for pick-up or drop-off locations outside the listed service areas must be discussed and approved in advance by contacting 0401 950 730.

We do not provide pick-up or drop-off services from schools, playgrounds, clubs, sporting venues, or similar locations unless expressly agreed in writing.

3. Bookings

Lessons may be booked via:

  • Phone or SMS: 0401 950 730
  • Online booking system

Lessons may be scheduled up to ten (10) days in advance, subject to instructor availability.

Driving test bookings may be arranged up to twenty-eight (28) days in advance, subject to instructor and vehicle availability.

Briefing and debriefing time forms part of the scheduled lesson duration.

Lessons commence and conclude at the pre-arranged pick-up and drop-off location.

The Driving School reserves the right to refuse, cancel, or reschedule any booking at its sole discretion.

4. Payment Conditions

Full payment is required at the time of booking unless otherwise agreed in writing.

If payment has not been received in full, no booking will be created and no lesson or service is guaranteed.

Any outstanding fees constitute a debt payable immediately upon demand.

Accepted payment methods include:

  • EFTPOS (2% surcharge applies)
  • Electronic Funds Transfer (EFT)
  • Direct Deposit

A tax invoice will be issued for all payments.

By making a booking, you warrant that:

  • You are at least 18 years of age, or have the consent of a parent or legal guardian.
  • You are authorised to make payment.
  • All information provided is accurate, current, and complete.

5. Lesson and Driving Test Packages / Refunds

Package lessons are charged at the applicable individual lesson rate if the full package is not completed prior to the learner passing their driving test.

All prepaid lesson packages must be used within specific period mentioned in packages unless otherwise agreed in writing. Any unused lessons remaining after this period may be forfeited without refund.

Any approved refund is subject to:

  • A $60 administration fee; and
  • A $10 payment processing fee.

Refunds will only be processed using the original payment method or in bank accounts where possible.

Learn P Driving School does not provide drop-off services following the completion of a driving test. Students are responsible for arranging their own transportation after the test unless otherwise agreed in writing.

6. Cancellations, Rescheduling and Late Arrivals

Lessons may be cancelled or rescheduled without penalty if at least forty-eight (48) hours’ notice is provided.

Cancellation fees apply as follows:

  • Less than 48 hours’ notice: 50% of the lesson fee.
  • Less than 4 hours’ notice or failure to attend (No Show): 100% of the lesson fee.

If a learner arrives late, lesson time may be shortened accordingly and the full lesson fee will still apply.

If a learner is more than ten (10) minutes late without prior notice, the instructor may cancel the lesson and charge the full lesson fee.

The Driving School reserves the right to reschedule lessons with reasonable notice via SMS, telephone, or email.

Lessons may be refused if the learner is considered unfit or unsafe to drive.

7. Licence Requirements

A valid physical or digital driver licence must be presented at every lesson.

Photographs, screenshots, photocopies, or expired license’s will not be accepted.

Failure to produce a valid licence may result in lesson cancellation, and cancellation fees may apply.

8. Use of Learner’s Own Vehicle

The use of a learner’s private vehicle is subject to prior instructor approval.

Lessons conducted in the learner’s vehicle will:

  • Commence and conclude at the Castle Hill Service NSW testing centre car park unless otherwise agreed.
  • Be undertaken entirely at the learner’s own risk.

The learner is solely responsible for ensuring that the vehicle:

  • Is registered and roadworthy.
  • Is properly insured.
  • Complies with all NSW road laws and regulations.

The instructor reserves the right to terminate a lesson immediately if the vehicle is considered unsafe or unsuitable. Full lesson fees will apply.

9. Private Vehicle Conditions

Vehicle Requirements

The vehicle must have:

  • Current registration.
  • Valid insurance.
  • Roadworthy tyres.
  • Functional seat belts.
  • No significant windscreen damage.
  • Sufficient fuel for the lesson.

Insurance

The learner is responsible for notifying their insurer that driving lessons will be conducted in the vehicle.

Traffic Offences

The learner remains solely responsible for all traffic infringements, fines, penalties, towing fees, or other costs incurred while operating their vehicle.

Liability

The learner agrees to indemnify and hold harmless Learn P Driving School, its instructors, employees, and representatives from any claims, losses, damages, liabilities, or expenses arising from the use of the learner’s vehicle.

10. Driving Test Packages and Booking Limitations

Payment for driving lessons, driving test packages, vehicle hire, or any other services does not automatically guarantee lesson availability, driving test bookings, instructor availability, vehicle availability, or a specific date, time, or location.

All bookings remain subject to confirmation by Learn P Driving School.

Students are strongly advised to first secure a driving test appointment through Transport for NSW (Service NSW) and then contact Learn P Driving School to confirm instructor and vehicle availability before making payment.

Payment made prior to confirmation of availability is made at the student’s own risk.

If payment is received before a booking is confirmed, Learn P Driving School cannot guarantee the requested instructor, vehicle, date, time, or testing center.

Alternative dates and times may be offered subject to availability.

Students are responsible for:

  • Holding a valid licence.
  • Meeting all Transport for NSW eligibility requirements.
  • Providing accurate booking information.

Learn P Driving School is not responsible for cancellations, changes, delays, or rescheduling by Transport for NSW, Service NSW, or any driving test center.

A booking is considered confirmed only after written confirmation has been provided by Learn P Driving School.

Under any package, a maximum of two (2) active future bookings may be held at any one time.

Bookings exceeding this limit may be cancelled, declined, or rescheduled at the Driving School’s discretion.

11. Parent/Guardian Attendance and Private Practice Disclaimer

Learn P Driving School and its instructors do not provide advice regarding when a learner should commence private driving practice with family members or supervisors.

One (1) parent or guardian may attend one lesson for observation purposes only.

Attendance by a parent or guardian does not constitute approval, certification, or recommendation that the learner is ready for unsupervised or private driving practice.

12. Mobile Phone and Device Use Policy

Student Mobile Phone Use

Students must not use a mobile phone or electronic device while the vehicle is in motion.

Calls, messages, and device use may only occur when the vehicle is safely parked.

Any lesson time interrupted due to mobile phone use may be deducted from lesson time.

Instructor Mobile Device Use

The instructor may use a securely mounted mobile device for navigation, traffic monitoring, lesson management, or safety-related purposes.

The instructor will not engage in personal browsing or unrelated mobile phone activity during lessons.

Students acknowledge that smartphones may display automatic notifications, predictive text suggestions, voice-activated prompts, or system-generated content without deliberate user interaction.

Student safety remains the highest priority at all times.

13. Provision of Lessons and Conduct

Learners must comply with all lawful instructions given by the instructor.

Lessons may be terminated immediately if:

  • Unsafe or inappropriate behavior occurs.
  • Licence conditions are breached.
  • The learner is deemed unsafe to continue driving.
  • The learner is affected by alcohol, drugs, fatigue, illness, or any condition impairing their ability to drive safely.

Where a lesson is terminated for any of the above reasons, the full lesson fee remains payable.

14. Vehicles Supplied by the Driving School

Learn P Driving School provides automatic transmission vehicles only.

Vehicles may contain GPS tracking systems, dashboard cameras, audio recording devices, and other safety or monitoring equipment.

Learners remain responsible for all traffic infringements, fines, penalties, and offences committed while operating the vehicle.

If damage occurs to a Learn P Driving School vehicle due to the fault or negligence of the learner while undertaking a driving test and the instructor is not permitted to be present in the vehicle, the learner may be liable for an insurance excess of up to $1,000, subject to the terms and conditions of the applicable insurance policy.

15. Fitness to Drive

The learner must be physically and mentally fit to drive at all times.

The instructor may refuse to commence or continue a lesson if the learner appears affected by illness, medication, alcohol, drugs, fatigue, emotional distress, or any other condition that may compromise safety.

Full lesson fees may apply where a lesson cannot proceed for these reasons.

16. Privacy

Personal information collected during the provision of services will be handled in accordance with applicable privacy laws.

Information may be collected, stored, used, and disclosed for:

  • Booking administration.
  • Lesson delivery.
  • Safety monitoring.
  • Insurance purposes.
  • Legal compliance.
  • Responding to lawful requests from government authorities.

Lesson recordings may be retained for training, safety, insurance, compliance, and dispute resolution purposes.

17. Acknowledgements

By booking or attending lessons, learners acknowledge and agree that:

  • Passing a driving test is not guaranteed.
  • Driving involves inherent risks.
  • Lessons may be recorded for safety and operational purposes.
  • Lesson results, testimonials, photographs, and videos may be used for promotional or social media purposes with the learner’s consent where required by law.
  • The Driving School is not responsible for decisions made by Service NSW examiners.
  • Any concerns regarding lesson conduct should be raised with the instructor as soon as possible to allow prompt resolution.

18. Circumstances Beyond Our Control

Learn P Driving School shall not be liable for any delay, cancellation, interruption, rescheduling, or inability to provide services due to circumstances beyond our reasonable control, including but not limited to:

  • Severe weather conditions.
  • Road closures or traffic incidents.
  • Vehicle breakdowns.
  • Instructor illness or injury.
  • Government restrictions or regulatory changes.
  • Service NSW or Transport for NSW scheduling changes.
  • Natural disasters.
  • Power outages.
  • Telecommunications failures.
  • Any other unforeseen event beyond our reasonable control.

Where reasonably possible, affected lessons or services will be rescheduled to a mutually convenient date and time.
